Estate With Multiple Beneficiaries and No Executor Named
Challenge
A family of five adult children came to us following their mother's death. She had left a will naming specific assets for each child, but had not appointed an executor. The family was uncertain who had authority to act and the estate included both property and bank accounts.
What We Did
We applied to the Bangkok court for the appointment of one of the children as administrator. We guided the family through the documentation requirements, managed court filings, and liaised with the relevant financial institutions to freeze accounts pending settlement.
Outcome
The probate order was granted within the expected timeframe. All five beneficiaries received their respective shares without dispute. The family noted that the process, while unfamiliar, was easier than they had feared with clear guidance at each stage.
Contested Gift Made Before Death
Challenge
Two siblings disagreed about a property transfer their father had made to one of them two years before his death. The other sibling felt the transfer had been made under pressure and should be treated as part of the estate for equal division.
What We Did
We reviewed the transfer documentation and the circumstances under which it had been made. We facilitated a series of structured discussions between the parties and their respective support persons, with the aim of reaching a mediated agreement rather than court proceedings.
Outcome
An agreed financial settlement was reached that acknowledged both parties' positions. The property transfer was upheld, and a compensatory arrangement was agreed for the other sibling. The siblings' relationship, while strained, remained intact.
Will Preparation for a Mixed-Nationality Family
Challenge
A Thai national married to a European partner wanted to prepare a will covering Thai property, a joint bank account, and personal assets. There were concerns about how Thai law would treat the foreign spouse and what steps could be taken to protect their interests.
What We Did
We advised on the specific provisions in Thai succession law that affect foreign spouses, prepared a will that worked within those parameters, and recommended additional steps regarding the joint account to reduce uncertainty at the time of death.
Outcome
The will was completed and signed within two weeks. Both partners felt their intentions were clearly recorded and that the document would hold up under Thai law. They have since returned for an annual review.
